LOYALTY OF THE PENGUIN... & THE MONKEY'S HEART...




Yesterday, the Hon’ble PM while interacting with the 167 IRS Probationers exhorted them to keep a sense of trust for the people of India in course of their work. The officer must feel that each and every citizen of this country is part of his family. If this spirit prevails, then the officers will be able to work with vigour and enthusiasm and even the question of exhaustion will not arise. He also expected from the civil servants a sensitive and humane approach.
The young batch of IRS Officers is fortunate to have interactions with the Hon’ble PM, who shares his views to inspire and guide to prove best civil servants to serve the people.
Alas, it appears that there was no one to guide the earlier batches of IRS officers as most of them are engrossed in their motivated activities. There is no sense, no human touch, no feelings, forget about remorse…

Penguin swims 5,000 miles every year for reunion with the man who saved its life


Today's most heartwarming story is brought to you from a beach in Brazil.

It's the story of a South American Magellanic penguin who swims 5,000 miles each year to be reunited with the man who saved his life.

Retired bricklayer and part time fisherman Joao Pereira de Souza, 71, who lives in an island village just outside Rio de Janeiro, Brazil, found the tiny penguin, covered in oil and close to death, lying on rocks on his local beach in 2011.

Joao cleaned the oil off the penguin's feathers and fed him a daily diet of fish to build his strength. He named him Dindim.

After a week, he tried to release the penguin back into the sea. But, the bird wouldn't leave. 'He stayed with me for 11 months and then, just after he changed his coat with new feathers, he disappeared,' Joao recalls.

And, just a few months later, Dindim was back. He spotted the fisherman on the beach one day and followed him home.

For the past five years, Dindim has spent eight months of the year with Joao and is believed to spend the rest of the time breeding off the coast of Argentina and Chile.

It's thought he swims up to 5,000 miles each year to be reunited with the man who saved his life.

'I love the penguin like it's my own child and I believe the penguin loves me,' Joao told Globo TV. 'No one else is allowed to touch him. He pecks them if they do. He lays on my lap, lets me give him showers, allows me to feed him sardines and to pick him up.

'Everyone said he wouldn't return but he has been coming back to visit me for the past four years. He arrives in June and leaves to go home in February and every year he becomes more affectionate as he appears even happier to see me.'

Biologist Professor Krajewski, who interviewed the fisherman for Globo TV, told The Independent: 'I have never seen anything like this before. I think the penguin believes Joao is part of his family and probably a penguin as well.

'When he sees him he wags his tail like a dog and honks with delight.

And, just like that, the world seems a kinder place again.

COLLUSION...? RING INVITES KING...


 

Ever since the owner of Kingfisher Airlines (KFA) Shri Vijay Mallya expressed his desire to settle down in London with his children, all the members of consortium of financiers of Kingfisher Airlines are desperately pursuing all agencies to get their money back.

As on date the Chairman of Sahara group is whiling away his time in the secure Tihar Jail for financial irregularities which was unearthed by the dynamic SEBI officials. The money allegedly laundered by Sahara group belonged to private individuals whereas the Kingfisher case is different. This company had taken or rather been granted loans by various Public Sector Banks for expansion of their airline business. CESA-Mumbai has nothing to say about the other financial transactions or irregularities committed by the said company or its owner, but has the right to comment about the discriminatory manner in implementing Service Tax laws in the case of this company.
 
As on date, Service Tax official records shows around Rs.520 Crores (Rs. 52 Crores collected but not deposited) & the rest in confirmed demands . The money belonged to the passengers who pay the tax to the government while purchasing the ticket but unfortunately the same has not been deposited into the Govt. exchequer by the airline. Rather, the amounts collected in cash have been utilized by the company. As per the Service Tax laws, any person who has collected ST, but not deposited the same and if the amount exceeds Rs.50 Lakhs for over six months, is liable to be arrested. In 2016 budget it is proposed to be raised to Rs. 2 Crore. All the demands are confirmed prior to this announcement. In spite of the ST law being very clear at that point of time, Shri Mallya was never arrested !!
 
When summons were issued to the Chairman of Kingfisher Airlines, Shri Mallya approached the then Chairman, CBEC, Shri S. K. Goel.
 
On 25.07.2012, for the first time, Shri Mallya entered the Service Tax office premises at Churchgate, Mumbai and was ushered into the Commissioner’s cabin., i.e. before Shri Sushil Solanki, the then ST-I Commissioner. Shri Mallya's statement was recorded in the Commissioner's cabin by the Commissioner himself. Thereafter the accused was escorted by the Commissioner himself and seen off upto the lift !! This was the type of treatment accorded to by the Department to a huge tax evader...

Shri Mallya's statement should have been recorded in the cabin of the officers who are investigating the case or by their immediate supervisory AC (Anti-Evasion) / ADC (Anti-Evasion), whose office was at Madhu Indl. Estate, Worli.
 
When the amounts of default runs into hundreds of crores of rupees, why the person responsible for such deliberate default was not arrested, has now become a million dollar question. Why there was such a discrimination, when the Department was/is so harsh in taking action against its own employees for any revenue loss or for even minor irregularlities like taking leave without intimation ?
 
Officers of Mumbai are known for the arrests of several celebrities, for comparitive smaller amounts evaded, then why is such a big celebrity allowed to roam free till date? What has been seized by the Service Tax Department is a mere six “aircrafts” and two helicopters, at different places, but do not have any seizure value mentioned in the records !! It is anybody’s guess as to how much they are worth today. The Department is in the DRT and has also launched prosecution against the Chairman of KFA in the CMM court, where he has been given bail. But there is no move for taking further action against the said airline, like in the case of other small defaulters. 
 
The tax collected belongs to the country and needs to be paid or recovered forthwith and those who are collaborating with such evaders should not be spared whether that person is in service or otherwise. When the bankers and the agencies are tightening the noose, the Department should not be seen as lagging behind in recovering the dues.
 
The king should be in the ring and each penny collected as Service Tax but not deposited, should be recovered alongwith interest and all senior officers who have colluded with him should not be spared.
 
He may claim that he is not a defaulter, but records show that KFA is an evader of Service Tax and is liable for penal action.
 
When there was a golden period, all the senior officers were around the king of good times, but now it has been shunted down to a Superintendent level officer to attend to the DRT, Courts etc. to recover the amounts...

OFFICES NEED OFFICERS, NOT DICTATORS...


To pay our respectful homage, as well as a mark of protest, a blood donation camp was held at Lotus Building where late Shri Phadke was posted.
The response was overwhelming and the anger among the officers was clearly visible.
Shri Piyusha Patnaik, Chief Commissioner, Mumbai Service Tax Zone & Shri M. R. R. Reddy, Commissioner, Service Tax-IV, Mumbai, came and acknowledged the cause.
Thereafter, the delegation of CESA Mumbai and IRS (IDT) Promotee officers met Shri Piyush Patnaik, Commissioner, Service Tax-III who is also holding the charge of Chief Commissioner, Service Tax Mumbai Zone.
It was conveyed to the Hon'ble CC that the behavior, attitude and conduct of Shri Khandelwal, Additional Commissioner, Service Tax-III was just like a dictator and he treats his subordinates including Assistant / Deputy Commissioners like slaves.  He is not honest and his greed has no limits and this emboldens him to treat and behave with subordinate staff the way he desires. In CC's absence, as he is holding both the charges and is not able to concentrate on the affairs of Service Tax III Commissionerate, Shri Khandelwal's behaviour is just like as if he is the Commissioner of Service Tax-III.  As he has managed his earlier postings in Mumbai Customs, JNPT, Kandla & Mumbai airport, he thinks of himself as if he is the son of Kubera.  Shri Kandelwal humiliates and misbehaves with the newly promoted ACs before the subordinate officers, citing incompetence, is a daily routine. He himself sends bundles of files relating to TDS matter to another officer posted outside the Commissionerate, seeking his advice…..He is not bound by the tone, tenor and accent of decent language, crosses all limits and does not acknowledge the presence of lady officers around while using foul language.
Death is inevitable, but the way Shri Phadke had to end his life was not deserved by an uniformed officer with a long and unblemished service record. The mental pressure was so much, and the thought of facing an abusive officer like Shri Kandelwal again when he reaches office was too much to bear. This was narrated to his close friend a day before his death. It was his goodness that before he left the world, that he did  not name any one in his last note. But everyone in the office as well as his family knew what  and who made him to take such an unfortunate and drastic step. Mr. Khandelwal has now became infamous & is now a household name in all the officers’ families as being a monster and his terror tactics make most of the officers sick, both physically and mentally.
In ancient times, after seeing the dead bodies scattered around the battlefield, the Great Ashoka became  Chanda–Ashoka to Dharma-Ashoka but Shri Khandelwal has or shows no remorse, no regret in losing one of the officers under him.
As the CC is a gentle, simple and honest  person in nature, and unable to give his full attention to the affairs of Service Tax-III, Shri Khandelwal is taking advantage and misusing/abusing his position and the trust reposed in him by the CC.
After the incident, as the entire staff of the Service Tax Commissionerate do not want any other person to become a victim of his unprofessional behaviour, it is unanimously felt that Shri Khandelwal should be immediately transferred out and an enquiry be initiated into the untimely death of Shri Phadke, and to ascertain the facts leading to his unfortunate death. His behavior and approach is notorious and is known to all his past superiors. Even Shri Sushil Solanki, M. R. R. Reddy & Prashsant Kumar, our earlier Commissioners, knew this and had transferred him out from their charge.
His continuation in the Service Tax will dent the image of the Commissionerate as well as the CC's personal reputation which has been nurtured and built over the decades and will adversely affect the morale of all the Departmental officers.
Lastly it was appealed to the Hon'ble  CC to take exemplary action against Shri Khandelwal and to hold an enquiry before 18.03.2016 (completion of one month after Shri Phadke's death).



AIRPORT POSTINGS

      Willingness for posting to Mumbai CSI Airport has been called for (10 vacancies) and the last date for submission of application is 11-Mar-2016.
 
    Interview for one post of Superintendent for posting to Chennai Airport is over today.
 
    CESA, Mumbai, & the Adminsitration is trying hard to increase the numbers of vacancies allotted to Central Excise pool for posting to Mumbai CSI Airport. Letter addressed to Pr. Chief Commissioner of Customs, Mumbai Zone-III is appended below :-

Sub:    Filling up of vacancies of Air Customs Officers & Air Customs Officers at CSI Airport, Mumbai – Reg.

Your kind attention is invited to the letter dated 02.02.2016 of Principal Commissioner of Customs (General) Mumbai, addressed to all Central Excise Cadre Controlling authorities, requesting them to depute officers to CSI Airport, Mumbai (Copy enclosed).

In the said communication, the sanctioned strength and the working strength of the CSI airport is mentioned. It is pertinent to note that since a considerable period a good number of posts are lying vacant. After restructuring the number of sanctioned posts of officers at CSI airport has been revised upwards and accordingly the posts of officers been revised upwards from 180 to 216 (approximately 20% more).  However, in the said communication of Principal Commissioner (General), it is observed that the posts for Central Excise pool has not been revised upward proportionately and the same needs to be revised.

Further, your kind attention is invited to Airpool Policy issued by the CBEC vide F. No. A 11019/22/2007-Ad.IV dated 22.12.2008.  Para 3 (ii) of said policy is reproduced below:-
ii. In case where 25% quota of ACS / ACO from specified outside Customs and Central Excise Commissionerates is not getting filled up, the same shall be extended to all Commissionerates of that category, i.e. if the outside quota is for specified Customs Commissionerates, it shall be extended to all outside Customs Commissionerates and if the outside quota is for a specified Central Excise Commissionerates, the same shall be extended to all Central Excise Commissionerates.”

Due to acute stagnation in Mumbai Zone, senior and well experienced officers are available in Mumbai, as compared to the other Zones and their services can be utilized.

   Further, it pinches that most of the officers of Mumbai, who pass near the CSI airport, either by road or metro, but never had an opportunity to work in the airport, in spite of their eligibility and availability of vacant posts. Officers from other parts of the country came and worked here in the Airport, but so many officers from Mumbai residing in the same city, adjacent to the airport, is being deprived of this opportunity. It is pertinent to state that the administration also will be benefitted by posting officers from Mumbai to the CSI airport as no additional costs will be incurred to the Department and its struggle to provide accommodation to outside officers will be reduced to a great extent.   

In light of the above, CESA Mumbai, requests your goodself to consider and allot an additional 30  posts from Central Excise Pool to Superintendents of Central Excise Mumbai Zone in CSI Airport, Mumbai, and amend the letter dated 02.02.2016 revising the strength position as per the new revision of staff position allotted by CBEC vide order F. No. 11019/08/2013-Ad-IV dated 28.05.2015.

In the past, the cadre controlling authorities of Delhi as well as Mumbai have also posted additional officers in the both the airports.

It is therefore, requested that   the sanctioned strength of Central Excise Officers to be posted to CSI airport may kindly be revised upward proportionately, and communicated to all Central Excise Cadre Controlling authorities.

APPEAL...


Shri Ravindra S. Phadke, posted to Service Tax Zone, Mumbai, met with an untimely death on 18.02.2016. He was an honest, upright and down to earth officer. He joined the Department in 1993 and worked at various places in the department. He got his first promotion as Superintendent, a few months back and since then was posted to Service Tax–III Commissionerate. Due to tremendous work pressure, lack of supporting staff, and non-congenial working conditions combined with inhumane and irresponsive behavior of some of his immediate superiors, all this took a toll on him and lowered his morale.

            He is survived by his wife and son. The incident has shaken his entire family as well as the officers & colleagues working along with him. His financial position is also not sound enough to support the bereaved family in their day to day needs and the costly Engineering education of his son.  At a time when the family needed his support, the bread-earner of the family succumbed to mental pressure created at the work place.

            The issue of mental stress on officers will be taken up at an appropriate level by the CESA-Mumbai, but the urgent need is to help the bereaved family financially to manage their immediate needs till alternate arrangements, by getting compassionate employment for his wife/son and to get the remaining dues from the Department, (which is not enough as the number of years put in the Department were less).

            Considering all these, CESA-Mumbai appeals to one and all to contribute generously for the cause and help the bereaved family. For this purpose the following officers are assigned as per the list attached.

            The officers assigned the above task are requested to complete it by 25-March-2016 and hand over the funds collected, in the attached Performa, to the undersigned, for further accounting and disbursement.

UNIQUE BLOOD DONATION CAMP...

       Blood Donation camps are arranged to meet the shortage of blood and its components at various hospitals in the time of emergencies and operations. Donation of Blood is termed as one of the most sacred & humanitarian acts.

       To pay homage to our dear departed colleague, Shri R. S. Phadke, Superintendent, a Blood Donation camp is being organised by CESA, Mumbai, to be held at Lotus Buidling, where Shri Phadke was last posted.

       All the staff members, either working at Lotus Building or at other locations, are requested to make this Blood Donation camp to mark the solidarity with the grieving family.
