FROM CESA'S DESK...


In many of the newly acquired office locations, cabins have been provided to the newly promoted Assistant Commissioners. However, there is a visible discrimination even in the providing of name plates to them vis-à-vis the direct recruit ACs, whose name plates depicts them as IRS officers whereas there is no such mention for the newly promoted ACs.  Do they not belong to the IRS cadre or is it the case of being children of a lesser God ?
On 28-May-2016, a meeting was convened by the IRS Promotee Officers’ Association, wherein the President, Secretary and other officer bearers of the Association were present. The Secretary General and President of the Superindents’/Inspectors’ Federation were also present on the occasion. Special invitee from Mumbai, the Secretary of CESA-Mumbai, Mr. Brahmakshatri, AC (Retd.) was also present. In the meeting it was decided to contest against the Misc. petitions filed by Mumbai Administrations, on behalf of the Board (showing that they have complied with the directions of the Mumbai-CAT in the case of draft Grp-A RRs).
It was also decided to explore the legal options of filing a petition in Mumbai-CAT against the newly published Grp-A RRs, which also does not include the 2118 temporary posts of AC, as approved by the Cabinet.
On MACP, it was decided that all the aggrieved officers will follow the procedure as done by Shri Harpal Singh, New Delhi, namely to file a representation with their respective offices about the grant of 3rd MACP in the grade of Rs. 6,600/-, then, once the office has rejected the representation, it is to be followed up with a grievance, as a CPGRAM.

The issue of regularisation of AC/DC from adhoc, since 2002 was also discussed and various CAT judgements.
For the first time, all the office bearers of all the three organisations in the CBEC were gathered and resolved to take up the issues jointly pertaining to the cadre.

Transfers & Postings

It appears that the IZT/ICT/AGT orders for 2016 will be delayed further. Joint meeting of the staff associations with the Mumbai Administration is scheduled to be held on 10-June-2016 at 4.30 pm. The issuance of minutes of the meeting and amendments to the Transfer & Posting Policy may take another 3 to 4 days.
All the Chief /Principal Commissioners will be attending the Annual Conference of Tax Administrators at new Delhi which is scheduled from the 16th to the 18th June-2016 and is to inaugurated by the Hon’ble PM of India. In view of the same, the orders will be delayed to the end of the 3rd week of the June-2016.

However CESA-Mumbai has requested both the CCs to issue the same at the earliest and to relieve the officers on or before 30-June-2016. In this week, the rotation orders of the Chief / Principal Commissioners / Commissioners are likely to be issued and if these are effecting some of the Commissionerates of this zone, the IZT/ICT/AGT orders may be further delayed.
In our previous blogs, the suggestions given to the Administrations for the changes to be made to the Transfer & Posting Policy have been put up. It is suggested that all those officers, who are interested in a change of Zone/Commissionerates, are requested to submit their representations to their respective Commissionerates/Zones through proper channel to avoid last minute requests. Further, any representations on the basis of medical grounds / super-annuation grounds or other compassionate grounds be submitted alongwith their supporting documents. It is also kindly requested to bring any instances of non-forwarding of representations to the CC office, to the notice of the office bearers of CESA-Mumbai.

Unrest in the AC/DC/JC/ADC ranks

It appears that the officers of the above mentioned ranks in Mumbai Central Excise & Service Tax zones were eagerly waiting for their rotation orders to Customs after completion of their 2 years tenure.  Also, options were called for from officers who will complete 2 years by July-2016. But their hopes were dashed as the cut-off dates were shifted from their order dates to an arbitrary date in May-2016 by the Customs Administration.
Due to this shortage of 1 or 2 months for completion of their 2 year tenure period, they will continue to remain in their sensitive/non-sensitive postings and were depived of being rotated to Customs. Though it pinches, but being senior revenue officers, they are duty bound to remain silent and are able to express their anguish only through mere murmuring.
