Madam,
CESA,
Mumbai, salutes your spirit and determination to make the things possible. The
proposal of the CR has passed through so many ups and downs. Many of your predecessors, failed to convert
the CR into reality. Within your stint tenure
you made CR possible, despite of legal hurdles and succeeded in rolling out the
CR proposals. The all Cadre of CBEC is
delighted and are thankful for your commitment to all Cadre within the time
span as scheduled by you.
We
have seen so many authorities in the same chair, which you got an opportunity
to occupy. But you had fulfilled your
duties with all sincerity, taking the entire fraternity of CBEC as yours and
being the head of the family, without any discrimination, distinction and undue
favour. You have satisfied the
aspirations of one and all, which is a rarest gesture, as on date. We have seen the officers in the fag end of
their career, becoming more insecure, selfish and start utilize their sources
for their benefit. CESA will always
remember you for your patient hearing of all our issues viz. infrastructure,
irregularity, in seniority lists, regional disparity etc. and promptness to
issue instructions as well as monitoring the same to redress without any second
reminder. Officers may come and go, but
the seeds of fragrance, which you have sowed, will go a long way and will
remind us for all your good work done to all the cadre of CBEC.
CESA
wishes you, on the eve of your retirement, for fulfillment of all of your
wishes as you have fulfilled our wishes. CESA will always remember you for your
yeomen work and will feel proud that we have served under you and will lend our
helping hand whenever you need us.

Mumbai place on record its sincere thanks to the Chair person and her team
which showed concern towards the promotion, vide Esstt. Order no.: 192/2014 dt
22.10.2014 and a touching message of our Chair-person in CBEC site to one and
all who extended their contribution, towards the starving cadre, shows the
present Board really takes concern towards this stagnated Cadre.
Hardly,
have we found such officers in the CBEC who take so much pain for the lower
officers. Earlier, when the Mumbai III
Central Excise Inspectors Association along with our All India Office Bearers
of the Federation, brought to the notice of Shri.B. K. Agarwal the then Member (P. & V.) the plight of many officers who
were suspended but their suspension was not revoked even after years, passed
immediate instructions and monitored on phone that all such cases are reviewed
and suspension were revoked. Similarly, Shri. V. K. Malhotra, in the same
capacity took initiative and released 130 posts of upgraded Superintendents. These tasks were performed in the last week of
their tenure.
We found the same spirit in the
present Chairperson, who by issuing late night promotion order No. 192/2014
dated 22.10.2014, gave a real Diwali gift is given to the Superintendent of
Central Excise & Customs, the most stagnated cadre in the department,
discriminated in all respect not only in service but even after retirement. These
officers will all feel elated when they find their name in promotion list on
the Diwali morning. It is a surprise also for those who are due to retire in
next the two months and were hearing about promotion since several years.
Madam,
while placing our gratitude towards this act of kindness, we bring to your kind
notice our concern also in this regard. It
is our humble submission that, before demitting office with great
satisfaction, you did something for this neglected cadre of Inspector and
Superintendents of Central
Excise, but for your herculean effort, the task will be incomplete, if the
following is not done to safeguard the interest of this cadre:
1. It is observed that in the past orders
of promotions were issued in the ratio of 6:2:1,
in which the share of Superintendents Central Excise out of 9 posts is fixed as
6. Though the share appears to be large, the actual number promoted compared to
the actual staff strength, is peanuts.
Even these 6 posts offered to the officers who are lucky to touch this
golden line retire in few years and the vacancy so arising is again subjected
to same allocation in 6:2:1. This is against the spirit for which the ratio is
worked out to give proper representation to all the feeding cadre and give a
chain impact to remove stagnation.
2. In
the present order, around 55 officers who got promotion by the aforesaid order will
be retiring in the months of October to December 2014. From January 2015 to October 2015 another 274
are due to retire. Thus total 329
officers will retire in just one year.
Now
if these posts are subjected once again for allocation in same ratio, then the
Central Excise officers will be the loser as compared to Customs
Superintendents and Appraiser promotees, as well as direct recruits, as they
have more number of years so they remain in office.
3.
It is therefore CESA’s request that a
panel be kept ready to fill the vacant post arising due to retirement of
Central Excise officers from Central Excise side, so that a chain impact be
maintained and the stagnation will be removed.
4. By this mechanism we may achieve the
parity in promotion in all the three steams and at lower level also. This is
one of the term of reference of CR, as was in the last two CRs, but could not
be achieved as the above mechanism is not been adopted and post not been filled
timely.
5. As per the DPC guide lines of DOPT
also, a panel has to be kept ready for the entire year on the basis of
anticipated vacancies and orders of promotion to fill up the vacant posts has
to be issued on time so that no post should remain vacant even for a single
day.
CESA
therefore, request to consider the above and issue suitable directives to DGHRD
and other concerned also to do the needful and implement the above suggestions.
This will go a long way to give relief to the stagnated cadre and motivate
officers also to do the work.

promotion from Inspector to Superintendent to fill the posts arising out of
cascading effect – reg –
This is to bring to your kind notice that the CBEC
vide Office Order no. 192/2014 dated
22.10.2014 has promoted 1863 officers as Assistant Commissioner. Consequent to
the cascading effect of the said promotion vacancies have arisen amongst all
the Central Excise Zones all over India.
As
you are well aware that while implementing the CR the instructions were given
to issue promotion orders on one date i.e. 30.09.2014. This was done keeping in mind the various
litigations that have arisen on the issue of Seniority of the officers across
the Zones. Accordingly all the Orders
were issued in the Zones.
It
is learnt, that in some Zones the Orders have already been issued to fill the
vacancies arisen out of the above said promotion order, whereas in some of the Zones
like Mumbai Zone, the work is still under process and in the preliminary stages
due to heavy workload of implementation of CR proposal.
To
maintain uniformity and fairness it will be proper to have one common date for
promotion for the posts arising out of cascading effect of the above order no.
192/2014 dated 22.10.2014, across all the Zones in the CBEC, so that no
injustice will done to any officer irrespective of his Zone and eligibility.

or instructions to that effect in this regard.

Dear Officers,
I take the opportunity
to congratulate the newly promoted Assistant Commissioners. The promotion of a
large number of Group B Officers has bridged substantially the long standing
stagnation at Group B level. This was also crucial for stabilizing the cadre
restructuring plan of the department.
It goes without saying that the
DPC of such a scale could not have
happened without the support of Members in CBEC and the untiring efforts of a
large number of officers. I would like to specifically applaud the effort put
in by DGHRD and her team of ADGs,
Additional Directors and other staff, the Members of the Committee constituted
for this purpose headed by CC Meerut, especially Mr.Yogendra Garg, Commissioner
and other Additional Commissioners who assisted in his endeavour. The Deputy
Secretaries and Under Secretaries/SO in
CBEC namely Mr. S.R. Sharma, Mr.Joseph Anthony and Mr. S.A. Ansari, Mr. Santosh
Kumar and their staff have worked extra hours and late nights to make your
Diwali bright. There are also officers in each zone who have done the required
groundwork, of collecting the large number of APARs and other certificates.
Their contribution is also appreciated and acknowledged.
I hope that the new Assistant
Commissioner would put in their best to further the agenda of the department
and deliver on the Government’s priorities. I would also urge officers to
refrain from unnecessary litigation as it delays the promotional prospects of their own respective cadres.
