APPEAL TO ALL MEMBERS



APPEAL

Office Bearers of CESA Mumbai conducted meeting with members in field, thereafter CESA had its Managing Committee meeting on 25.09.2014, and unanimously resolved to proceed to take legal recourse to resolve the issue of seniority which is constantly neglected by the Administration despite the best efforts and representations. Certain issues are not yet resolved as per the legal position till date.

  • The issue of Adhoc promotions is not yet resolved despite court intervention. Pune & Cochin Unit had filed the I.A. in Supreme Court seeking directions to Govt. on implementation of Para 4 of the Judgment of Supreme Court dated 03.08.2011. Petition is admitted and the date of hearing is 03.11.2014.
  • O.A. in Mumbai CAT will be filed by Pune, Nashik, Aurangabad/Goa/Indore & Mumbai for preparing a proper Seniority list of Central Excise on All India Basis, and fixing the Seniority as per merit of Staff Selection batch wise and no officer junior be placed ahead of seniors irrespective of zones/units. In short to get parity in promotion at all India level.
  • Implementation of decision pronounced in case of UOI Vs N. R. Parmar to all Members of CESA and of seniority of Mumbai Zone, as the clarifications issued by the CBEC on 03.09.2014 & again on 05.09.2014 are not enough to rectify the error and in the spirit of the judgment. As per the decision the seniority be fixed from the year of notification of vacancy and not of joining in the department.  (In Mumbai Customs and one or two zones of Central Excise, the Seniority has been revised as per the said judgement).  The revision will have a great impact; thus, CESA Mumbai will file a Petition in the Mumbai CAT on the above matter.

 For all these legal battles apart from support funds are also required and members during the meetings had also whole heartedly expressed the support for this causes and many of the members have already contributed before making this appeal to one and all. CESA therefore, request that members should contribute generously and at least one day’s salary be given for this cause. Members can contribute as they wish and Cheque be given in the name of ‘CESA MUMBAI’ or ‘CESA MUMBAI LEGAL’.

 Our efforts are to ensure justice and uniformity in matter of seniority and promotions and no room for manipulations. CESA had not opposed to CR or put any spanner to halt its implementation till date, the above efforts are only for ensuring that the officers who will remain in department after we leave shall enjoy the fruits of these efforts of all of us.

CESA cannot remain silent on injustice and stand by to the following lines.

“Be forthright, be frank, be fearless, whatever the odds, never hesitate to speak our boldly against the wrongs, and always ensure that you illuminate the truth behind the events”
