NO MORE M&P POSTING AFTER CADRE RESTRUCTURING

Subject:- Request for discontinuing of posting of staff from Central Excise to M&P Wing- Reg

 

Mumbai Central Excise caters the staff from the Inspector/ Superintendent Grade to M & P (Customs Preventive Mumbai) periodically. The tenure of posting is two years. The staff allocated to Central Excise is posted to M & P.

Now, the exercise of Cadre Restructuring is on. Notification regarding sanction of grade-wise Posts and new jurisdiction of the Commissionerates of Customs & Excise, is likely to be issued soon. Before a decision is taken in this regard, as suggested by Hon’ble Chief Commissioner Mumbai Zone-II vide her letter dated 28^th May, 2014 (copy enclosed for ready reference), a similar suggestion may be forwarded to the Board at the earliest. The discriminatory approach & step motherly treatment in the M & P Administration in the two wings of the Commissionerate is causing humiliation constantly to the staff posted from Central Excise. While the allocation of the post as well as marking of jurisdiction is going on, let the Mumbai Central Excise Administration forward the suggestion to the Board, to the extent that within the jurisdiction of Central Excise, we will carry out all the Land Customs, Central Excise & Service Tax related work, as the Officers of Central Excise are well versed with these types of work and are capable of handling any type of work, both in field and off field.

In light of above, CESA requests to your good self to kindly suggest to the Board not to provide any Officers from Central Excise to M & P Wing from our sanctioned strength. The M & P Administration for their smooth administration may demand their staff as per their work load.

RETIREMENT IN MAY-2014

STATUS OF THE DOSSIERS OF MUMBAI OFFICERS

Out of Dossiers of 37officers,  4 officers were expired, 1 officer dismissed from service , 4 officers have taken VRS,  18 officers have retired and  only 10 Officers are in service as on 1^st May, 2014.  As per the direction, the submission of Dossiers is in process by the Mumbai –I Administration and likely to be complied with by the end of this week.

Dear Colleagues,

                   Sub:- Promotion from Group ‘B’ to Group ‘A’, after CR.

            In my previous message dated 19.5.2014, at step No. VII, I had referred to the work relating to promotions of 2118 officers from Group 'B' to Group 'A'. The Board has since reviewed the work of Committee No II, Sub-Committee No.1, which          is looking after this task, along with the officers from the Ad.II Sections of the CBEC and DG, HRD.

2.       After obtaining the tentative consideration zone and the All India seniority list of Superintendents / Superintendents(P) /Appraisers from the DG, HRD in December, the Sub-Committee No.1 has obtained around 5000 folders from the various CCAs.         Individual folders for each of the eligible officers has been prepared containing the ACRs/APARs for the preceding 5 years. Work is in progress for ensuring that ACR/APAR folder is up-to-date which would include availability of vigilance status, integrity certificates, penalty statements (where necessary) availability of part period ACR/APAR, if any, in a particular financial year, completion of action in respect of 'Below Bench Mark' cases, No Report/No Review certificates, additional ACRs/APARs in the last mentioned types of cases, etc. Check List has been maintained in respect of each folder. Review of the work revealed that there are 256 dossiers from eight CCAs which are yet to be sent:-

3.       Though Member (P&V) has been contacting the above mentioned CCAs,  it would be appreciated if the Group 'B' Gazetted Officers Associations of these zones take up the matter of ensuring that the missing dossiers are forwarded to the Committee without delay, The Sub-Committee has moved forward with the action for completion of the dossiers and same is expected to be completed shortly. However, it is reiterated that unless the pending dossiers are also received and the same rigorous scrutiny done, we would not be in a position to move the UPSC for obtaining a date for DPC. All CCAs are, therefore, requested to bestow personal attention in the matter and the Associations are also requested to coordinate with the administration in this regard

4.       At the level of Ad.II Section in CBEC, necessary action is being taken for dealing with all representations received from individuals as also from Associations. The Ad.II Section will also be providing to the DG, HRD the number of carry forward / backlog vacancies which require to be filled so that the same can be included in the DPC proposal. The Ad.II will send the vetted list of the zone of consideration to the Sub-Committee to enable them to properly identify the dossiers required for the DPC. Once the dossiers are completed and forwarded by the Sub-Committee, the same will have to be completely vetted again before being certified by the appropriate authority in Ad.II and submission to the UPSC through the single window.

5.           I would again emphasise that existence of complete and correct dossiers is necessary before the proposal for DPC can be sent to UPSC. Therefore, I would request all CCAs and Associations to ensure that the action, as required at the zonal level, is expedited. It is evident that delay by even one zone would put in jeopardy the legitimate aspirations and expectations of the officers of remaining zones. Therefore, I look forward to a coordinated and quick response from you.

ORDERS ARE IN HUNG

CBEC issued placement order of 104 promoted ACs who were earlier promoted on in situ, giving regular posting vide order No.107/2014 dated 20/05/2014 and corrigendum to said order for amendment of posting of 6 officers on 21/05/2014.

CBDT also issued three placement orders of different Cadres on 16/05/2014 and 19/05/2014.

It is learnt that  upcoming Govt. has expressed their displeasure and taken a strong note of such placements & their implementations.

IS PATIENCE, COOPERATION, ANXIETY IN OUR DNA ?

Chairperson, CBEC in her message dated 20/05/2014 appeals that the officers, staff & associations should have patience, cooperate & assist the administration to the maximum so that the major activity of Cadre Restructuring can be carried out as smoothly & swiftly as possible.

In this regard:- The representatives of our cadre have always extended maximum cooperation from the date of announcement of CR till date. We are not impatient though every month our officers are retiring without entering into Group A service.

• Further, while creating new Commissionerates, we have been discriminated by the study group. The norms for creating new Central Excise Commissionerates, revenue as well as number of assessee is considered whereas for creating new Custom Commissionerates, number of documents is the criteria, inspite of the fact that handling of the clearance documents in Customs is under ICES 1.5 /EDI System, which is fully operation in Custom. Whereas, in Central Excise the fate of working of ACES is known to every one. 
• We are hopeful with number of permanent post as well as temporary post. We have patience and cooperated by not raising our voice against injustice made by the Board while approving the CR by citing the wrong figure of stagnation of Group B feeder Cadres. 
• We are silent on allocation of temporary post on account of our stagnation. 
• Even, we are silent on adopting ratio for allocation on temporary post.
• Our Apex Body is cooperating to remain stagnated further and further and extending their best to implement the CR even though we do not have proper seniority list, which is full of faults. The Zonal Seniority List compiled at Board’s level lacks uniformity. 
• Officers from one zone/Commissionerate have been placed much above their Senior counter parts by considering ‘deemed date’ of promotion.
• Many such instances show the whims and fancies adopted in preparing the Seniority List. 
• Lack of uniformity in implementing of DoPT OM dated 10.08.2010 & Board’s instructions vide F.No.A-29014/M/2011-Ad.IIB dated 24.10.2011 in all the CCA Zones is glaring. 
• We have cooperated by defending ourselves the DoPT OM dated 4.3.2014 but kept patience to face the humility by not raising our issues when the contempt petition of N R Parmar case is disposed off on 9/5/2014 by Apex Court.
• We have cooperated by keeping mum by not raising the voice before the Board to take the stand, as taken in the case of Appraiser (when they have exceeded the quota of promotion for them) while filing the affidavit by the Board in the Supreme Court in the WP No. 651 of 1997, while justifying ad hoc promotion to the appraisers as compared to us. 
• We have cooperated by not forcing the Board or demanding other stake holders to return the excess quota to us. 
• CESA Mumbai during several visits to Board Office made it’s stand very clear that the CR is not like a khairat, distributed by someone as charity. We condemn the approach and demand that Board should be fair, equal, just to Central Excise Superintendent Cadre in all aspects. The issue mentioned above cannot be rolled under the carpet before implementation of CR.

There is no need of any appeal by Board as our Body has lots of Patience and tend to co-operate with the Board even if some of the decisions or acts are not in the interest of the stagnated cadre.
