IS PATIENCE, COOPERATION, ANXIETY IN OUR DNA ?



Chairperson, CBEC in her message dated 20/05/2014 appeals that the officers, staff & associations should have patience, cooperate & assist the administration to the maximum so that the major activity of Cadre Restructuring can be carried out as smoothly & swiftly as possible.
In this regard:- The representatives of our cadre have always extended maximum cooperation from the date of announcement of CR till date. We are not impatient though every month our officers are retiring without entering into Group A service.
  • Further, while creating new Commissionerates, we have been discriminated by the study group. The norms for creating new Central Excise Commissionerates, revenue as well as number of assessee is considered whereas for creating new Custom Commissionerates, number of documents is the criteria, inspite of the fact that handling of the clearance documents in Customs is under ICES 1.5 /EDI System, which is fully operation in Custom. Whereas, in Central Excise the fate of working of ACES is known to every one. 
  • We are hopeful with number of permanent post as well as temporary post. We have patience and cooperated by not raising our voice against injustice made by the Board while approving the CR by citing the wrong figure of stagnation of Group B feeder Cadres. 
  • We are silent on allocation of temporary post on account of our stagnation. 
  • Even, we are silent on adopting ratio for allocation on temporary post.
  • Our Apex Body is cooperating to remain stagnated further and further and extending their best to implement the CR even though we do not have proper seniority list, which is full of faults. The Zonal Seniority List compiled at Board’s level lacks uniformity. 
  • Officers from one zone/Commissionerate have been placed much above their Senior counter parts by considering ‘deemed date’ of promotion.
  • Many such instances show the whims and fancies adopted in preparing the Seniority List. 
  • Lack of uniformity in implementing of DoPT OM dated 10.08.2010 & Board’s instructions vide F.No.A-29014/M/2011-Ad.IIB dated 24.10.2011 in all the CCA Zones is glaring. 
  • We have cooperated by defending ourselves the DoPT OM dated 4.3.2014 but kept patience to face the humility by not raising our issues when the contempt petition of N R Parmar case is disposed off on 9/5/2014 by Apex Court.
  • We have cooperated by keeping mum by not raising the voice before the Board to take the stand, as taken in the case of Appraiser (when they have exceeded the quota of promotion for them) while filing the affidavit by the Board in the Supreme Court in the WP No. 651 of 1997, while justifying ad hoc promotion to the appraisers as compared to us. 
  • We have cooperated by not forcing the Board or demanding other stake holders to return the excess quota to us. 
  • CESA Mumbai during several visits to Board Office made it’s stand very clear that the CR is not like a khairat, distributed by someone as charity. We condemn the approach and demand that Board should be fair, equal, just to Central Excise Superintendent Cadre in all aspects. The issue mentioned above cannot be rolled under the carpet before implementation of CR.

There is no need of any appeal by Board as our Body has lots of Patience and tend to co-operate with the Board even if some of the decisions or acts are not in the interest of the stagnated cadre.

    Let us now start for taking legal recourse. The justice on Seniority can not be expected without legal steps. The fraternity, of Direct Recruit Inspector Central Excise; is the worst sufferers. Let us think to unite[Gr-B Gazettd or non-Gazetted] for taking combined forum to STRIKE with full force.
    All DR Inspr CX should know, that this CR is NOT GIVING anything special to them, except DRY promises & DRY Promotions.
    Those remain inactive(or look at others to do good for them) shall badly repent, after CR.
    Come together, because NAYE DIN AANEWALE HAI, AA GAYE HAI. Use all your resources to get 'just & fair' career progression for the DR Inspr CX.
