Sub: Stepping up of pay of seniors, if junior is
drawing more pay on account of ACP/MACP upgradation/s.
Madam,
Kindly refer to the Ref. No. 76/M/13 Dt. 01.05.13 of the Association as well as letter
F.No. A-23011/06/2011/Ad.IIA Dt. 26.06.13 of the CBEC.
2. It
is submitted with due regards that the clarification has been issued
incompletely quoting some CAT judgements but ignoring the verdict given by the
Hon’ble Apex Court. The issue of stepping up of pay
regarding ACPS has been linked to pay revision of 2004 instead of issuing a
general & complete clarification based on Supreme Court verdict dt. 02.05.11 in SLP(C) No. CC 7278/11. The issue has been settled finally by the Hon’ble
Supreme Court vide the said verdict granting the benefit of
stepping up of the pay to seniors, if
junior is drawing more pay on account of ACP/MACP upgradation/s.

If a complete & exhaustive clarification is not issued based on Supreme Court verdict, many of our senior officers
particularly entered into the job through Ministerial cadre will suffer with
recurring loss due to the inaction of the concerned section on the issue. It is really not understood why the general
clarification can’t be issued based on the verdict of the Apex Court, if it is
conveniently issued based on CAT verdicts.
4.
In view of the above, it is requested that the much awaited general
clarification may also kindly be issued on the issue at an early date based on
the verdict given by the Hon’ble Apex Court.

Sub: Regularisation of ad hoc promotions as per the verdict
given by Hon’ble Supreme Court.
Madam,
Kindly refer to the various communications of the Association addressed to the
administration on the issue.
2. It
is submitted with due regards that the Hon’ble Apex Court directed the CBEC
vide the verdict of 03.08.11 in CWP No. 385/10 to regularise all the ad hoc
promotions made to the post of Asstt. Commissioner.
These ad hoc promotions are to be regularised since 1997 as no regular DPC has
been conducted for the promotion to the post of Asstt. Commissioner since then.

It is also well pertinent to submit that the CBEC sought the time upto
October,12 only from the Hon’ble Supreme Court for conducting the DPC to
regularize the said promotions. The time limit of
October,12 has already expired by more than 8 months but no DPC has been
conducted till date.
4. It
is also worth to submit that the said DPC is required to be conducted as per
the Recruitment Rules in force on the date of DPC and also the provisions of
extended panel are to be applied to the DPC.
5.
In view of the above, it is requested that the said DPC may kindly be conducted immediately as per the Recruitment Rules in
force on the date of DPC applying the provisions of extended panel.
