OUR COMMITMENTS TO THE BETTERMENT OF OUR CADRE OF MUMBAI ZONE- PART I


Staff Associations Meeting with Chief Commissioner

          As per the direction of Chairperson Cadre Controlling Authority, Mumbai zone convened a meeting with representatives of Recognized staff Associations, the communications dated 24th May, 2017 as addressed to us, received on the same day. Accordingly the delegation of CESA, Mumbai attended the meeting on 30th May, 2017 at 04:00 PM. The splinter group also attended the meeting without any invitation. When the meeting was started they raise the objections that we should not be allowed to represent. Chief Commissioner expressed his displeasure and said that the dispute within yourself be sorted out at outside and I will not interfere and only we will be concerned about the issues to be redressed at our end.

         We were maintaining a stoic silence about the splinter group commotion in the beginning. Then, the president of CESA, Mumbai expressed that all the schedules of our programmes already informed to our members as well as to the administration. Although we have been promoted but not taken the charge functionally, as soon as we take the functional post of the Assistant Commissioner, we will relinquish the post and in our place as decided by the managing committee other office bearers will represent CESA, Mumbai. Being a Chief Office Bearer of CESA, Mumbai I brought to the notice of Chief Commissioner 30th May, Indian Express News paper, the article appeared in page no. 12 about the topper scam of Bihar. It is known to everybody, how the Bihar Board (BSEB) manipulated and made their student in the limelight that they are the topper without any caliber. When the certificate was put to scrutiny the entire phase of manipulation are exposed without appearing, impersonation, other unethical methods papers are made and certificates were issued that they are the toppers only the certificates are obtained on crook methods
 Superintendents Association is not a labour union,Industrial union,It is a Staff welfare association,It heads range ,circle formation always maintained decency,decorum,and discipline so that junior officer will follow. We never adopt hooliganism and condemn if any office bearer possess the said quality for self promotion.
      
    Similarly the certificate on which this splinter group are claiming their existence and impersonating as CESA, Mumbai by few motivated, perverted, self seekers individuals with all short of manipulations like Topper Scam of Bihar the certificate of the Election Officers is not only fake but also baseless and doctored and engineered and fabricated one. Due to this impersonation we have made slight change in our letter head and we identify ourselves by incorporating name and designation of Secretary General/ President of AIACEGEO. Let them identify themselves with whom they belong of AIACEGEO and recognize themselves as authorized one then they may be allowed to represent the Superintendents of Mumbai in the banner of CESA, Mumbai.

        The issue raised by us point by point is highly appreciated by Chief Commissioner and promised that they will do their best. Thereafter, the meeting was moved on very smoothly. CESA, Mumbai lastly appreciate the efforts and vision of Chief Commissioner and his administration, not allowed any officers in any Cadre as excess and planned the No. of Commissionerates and formations accordingly so that all the field staff have been accommodated in Mumbai Zone. 

Meeting was concluded with a condolence meeting of Late V. R. Ghorpade.

Respected Sir,
            Please refer to above referred letter. CESA Mumbai is thankful to your goodself to continue with interaction with staff Association and holding JCM and inviting us for the meeting is an step towards the healthy administration.
            CESA sponsor the following points for discussion in the JCM :
1.      Database like zone II in respect of all officers, personnel, be prepared
2.     Digitalization of the records of confidential sections of Cadre Controlling Authority.
3.     New formations/Commissionerates should be within the jurisdiction
4.     Disposal of vigilance cases
5.     Disposal of all medical claims /LTC etc. in a time bound manner i.e. before  rolling out of GST.
6.     Officers on deputations/extended/loan basis be repatriated from DRI/DGCEI etc. and no extension be granted to them.
7.     As in the ensuing GST reorganization of the Customs preventive is in the stage of proposals as per the study report, the Customs work is being carried out by the Central Excise officers, be manned by Customs
Preventive officers, hence the staff position may be enhanced and the criteria of present transfer and posting policy to M & P after due deliberations will be formed.
8.     The amendment of the transfer and posting policy will be informed after deliberations in the AGM which is scheduled on the 9th June 2017.
9.     Improvement of infrastructure – no formation and office have any adhoc arrangement.
10.                        Provisions for Gym, place for Yoga and recreation, as per the new policy
      announced by the Hon’ble PM to keep the officers fit and motivated.
11.                         Land in our possession be safeguarded otherwise in the tsunami of GST our file will be misplaced.  The plots at Kharghar, Boisar, Thane, be developed.  The renovations carried out on various office/officers quarters should continue with the same speed and without any break.
12.                        Deployment of the staff and rotations after merging of the various Commissionerates in the new formations should not be carried out in haste.  Options called for are premature as the jurisdictions and offices are not specified by issuance of any Trade notice or circulars.  Hence the present exercise is hypothetical.  The request options pending with the administration be called for.  Officers should be posted near to their residence, Cases on compassionate ground be considered.  Officers due for retirement, their request may be acceded. 

  Lastly on behalf of CESA Mumbai, we place it on record, that because of your vision as well as concern towards all the Staff members, no officer found excess and accommodated as created number of Commissionerates on the basis of revenue as well as number of units on conservative measures.

Sub: - Internal Rotation of Assistant Commissioners within Mumbai Central Excise and Customs Zone – reg.


            Kind attention is invited towards weekly letter of Honorable Chairman CBEC, dated 26.05.2017, placed on the site of CBEC (copy enclosed). In the said letter in Para 2, it is stated that AGT orders of JC/ADC and posting orders of promoted Group ‘A’ is issued and rotation orders to be issued.
            Sir, We are concerned about the Central Excise officers who are promoted in the last restructuring and completed their two years tenure in Central Excise, Central Excise and Customs are eligible for rotations as per the internal prevailing transfer posting practise of Mumbai Central Excise and Customs Zone.
The cut off date may be taken for consideration Order to Order so that maximum officers can be covered.
Special care may be taken in respect of the officers posted in CCO, Appeals, Settlement Commission, Adjudications, CESTAT, etc.
Deputy Commissioners who have completed their two years in Central Excise may be rotated. But as far as the Direct Group ‘A’ officers are concerned, as they are just entering the service and completed technically two years in Central Excise and Service Tax may be retained, as they have a very long career, in Central Excise or ensuing GST Commissionerates.
Officers those who are due for superannuation upto June, 2018 may not be considered for rotation.
Other promotee officers who have completed their tenure in Central Excise, Service Tax and Customs may be rotated. 
           
In the pretext of non-training on GST officer of Customs in enmass may not be retained in Customs. As all the officers are qualified and well conversant with the taxation laws, GST is non a rocket science which they cannot cope up. Hence, non-training or training on GST should not be an hindrance for smooth rotations.
            Officers on compassionate grounds as well as self sickness may be considered.

            There was strong resentment in the last year AGT order. CESA, Mumbai hope that the same should not be repeated and the AGT will be fair and transparent one.
